Welcome to Trutopia LLC dba Highsale ("Highsale," "Trutopia LLC dba Highsale," "we," "us," or "our")! We provide sales workflow automation tools to help your team connect inbound forms, CRM systems, scheduling tools, and messaging platforms into a single automated workflow.
When you use Trutopia LLC dba Highsale, you enter into a legal agreement, which is what you see below. These Terms of Use include an agreement to resolve any disputes through binding arbitration that includes important disclaimers, warranties, and limitations on liability.
By accessing and using our Services (defined below), you are agreeing to these Terms of Use, our Privacy Policy, any applicable Additional Terms (collectively referred to as the "Agreement"). It is important to read our entire Agreement carefully as some of the provisions affect your legal rights.
1. Our Services
When we refer to our "Services," we mean all products and services owned and operated by Trutopia LLC dba Highsale, including the content, features, tools, data, software, SMS/text messaging services, and functions made available by us through our website at https://site.highsale.com/home or applications we operate, unless those websites or applications have posted separate or additional terms of use.
We reserve the right in our sole and absolute discretion to make changes to how we operate and provide our Services, including adding new services, modifying existing services, or suspending, discontinuing, or terminating your access to any or all portions of our Services. Some of our Services may be subject to additional terms and conditions ("Additional Terms"), which are posted separately from these terms but are incorporated and form a part of the Agreement if you decide to use or access those features.
2. Your Highsale Account
2.1 General Requirements
You will need to register for a Trutopia LLC dba Highsale member account to access many aspects of our Services. By registering for a Trutopia LLC dba Highsale member account, you certify that:
- You are 18 years of age or older
- Any information you provide to us, both when you register and in the future, is and will be true, accurate, current, and complete
- You are only registering an account for yourself or on behalf of a business you are authorized to represent
- You will keep all information up to date
You must not sell, transfer, or assign your account to anyone else. You must keep your password confidential, you must not share it, and you may not allow anyone else to log into our Services as you. You are responsible for all activities that occur under your member account.
2.2 Specific Registration Consents
When you register as a member, you authorize us to create and maintain an account in your name using your account registration information and other information that may be collected about you in accordance with our Privacy Policy. When registering, you authorize your wireless carrier to share your account device information with our third-party service provider only to verify your identity and prevent fraud.
2.3 SMS/Text Messaging Terms
By providing your mobile phone number and opting in, you consent to receive SMS/text messages from Trutopia LLC dba Highsale. We may send SMS/text messages for the following purposes:
- Appointment reminders
- Application or demo scheduling updates
- Account notifications
- Customer support messages
- Service-related alerts
- Promotional or marketing messages, but only if you have separately opted in to receive such messages
Consent to receive SMS/text messages is not a condition of purchase. Message frequency varies. Message and data rates may apply.
You may opt out at any time by replying STOP to any message you receive from us. After you send STOP, you will receive a confirmation message and will no longer receive SMS/text messages from us unless you opt in again.

3. Limitations and Restrictions on Use of Our Services
3.1 Analysis and Estimates
Any analysis and estimates we provide as part of our Services are for illustrative and informational purposes only. Our analysis and estimates are based on certain assumptions and use only the data we have. The methodology we use to determine which information is presented or highlighted is proprietary.
3.2 Third Party Integrations
Our Services integrate with third-party platforms such as CRM systems, scheduling tools, and messaging providers. We do not guarantee the availability, performance, or continued support of any third-party platform, and we are not responsible for the acts or omissions of third-party providers.
3.3 Educational and Informational Purposes
All information on our Services is presented for educational and informational purposes only. We do not guarantee that the information we present is the same information that may be used or reviewed by a third party.
3.4 Not a Professional Advisor
Trutopia LLC dba Highsale is not a legal, tax, or other professional advisor as defined under federal or state law.
3.5 Territorial Restrictions
We control and operate our Services from the United States and we make no representations or warranties that the information, products, or services provided through our Services are appropriate for access or use in other jurisdictions.
3.6 Compliance with Law
You must comply with all applicable laws when using our Services.
3.7 Links to or Connections with Third Party Sites or Applications
Our Services or communications to you may contain third party content or links to third party sites, applications, or services. We do not control, maintain, or endorse the Third Party Content or Third Party Services, and we are not responsible or liable for any Third Party Content or Third Party Services.
4. Ownership and Infringement
4.1 Our Content
All content and materials provided by us through our Services ("Content") and all related intellectual property rights are the property of Trutopia LLC dba Highsale and/or its third-party licensors. You may not reverse engineer or reverse compile any of our Services.
4.2 Our Partners' Intellectual Property
Our Services may also display certain intellectual property owned by our partners. Nothing in the Agreement grants you any license or right to copy, modify, sell, reproduce, distribute, or transmit any of our Partners' Intellectual Property.
4.3 Infringement of Rights
You may not use our Services in any manner that infringes the rights of any third party. Trutopia LLC dba Highsale reserves the right to block or otherwise prohibit any individual who repeatedly posts materials that are alleged to infringe the intellectual property rights of others.
5. Contributing to Our Community
We may provide you with the opportunity to submit, post, and publish certain content and materials ("Community Content"). By submitting Community Content, you grant to Trutopia LLC dba Highsale a non-exclusive, unrestricted, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use your Community Content. You are solely responsible for the Community Content that you submit.
6. Monitoring of Our Services
Trutopia LLC dba Highsale has the right, but not the obligation, to monitor our Services electronically. We may access, use, preserve, transfer, or disclose information as reasonably necessary to: (1) comply with applicable law; (2) enforce this Agreement; (3) protect safety, integrity, rights, or security; or (4) detect, prevent, or address fraud, security, or technical issues.
7. Disclaimers
WE PROVIDE OUR SERVICES, OUR CONTENT, AND ALL CONTENT AND MATERIALS AVAILABLE THROUGH OUR SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED. Trutopia LLC dba Highsale disclaims all warranties of any kind, whether express or implied, relating to our Services, including the implied warranties of merchantability, fitness for a particular purpose, quality, accuracy, title, and non-infringement.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM OUR SERVICES WILL CREATE ANY WARRANTY REGARDING TRUTOPIA LLC DBA HIGHSALE THAT IS NOT EXPRESSLY STATED IN THESE TERMS. You use our Services at your own discretion and risk.
8. Limitation of Liability
To the fullest extent permitted by law, Trutopia LLC dba Highsale and its representatives, agents, officers, directors, employees, parent entities, subsidiaries, and affiliated entities (the "Highsale Parties") will not be liable to you for any special, indirect, incidental, consequential, or punitive damages arising out of or relating to our Services, including delayed or undelivered messages.
In no event will the total liability of the Highsale Parties exceed one hundred United States dollars ($100.00).
9. Indemnification
You will defend, indemnify, and hold harmless the Highsale Parties from and against any claims, losses, expenses, or liabilities arising out of: (1) your use of our Services; (2) your violation of the Agreement or applicable law; (3) your infringement of any rights of any person or entity; or (4) any dispute between you and a third party.
10. Dispute Resolution and Arbitration
10.1 Generally
You and Trutopia LLC dba Highsale agree that any disputes arising in connection with the Agreement will be resolved by binding arbitration. The Federal Arbitration Act governs this arbitration provision; the arbitrator shall apply Arizona law to all other matters.
YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THE AGREEMENT AND AGREEING TO ARBITRATION, YOU AND TRUTOPIA LLC DBA HIGHSALE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
10.2 Exceptions
Nothing in the Agreement will be deemed to waive the right of either party to: (a) bring an individual action in small claims court; (b) file a complaint with a federal, state, or local agency; (c) seek injunctive relief in aid of a pending arbitration; or (d) file suit for injunctive relief regarding intellectual property infringement.
10.3 Arbitrator
Any arbitration will be conducted under the Consumer Arbitration Rules of the American Arbitration Association ("AAA") and administered by the AAA.
10.4 Notice and Process
A party who intends to seek arbitration must first send a written notice of the dispute to the other by certified mail. You and Trutopia LLC dba Highsale agree to use good faith efforts to resolve the claim directly within 30 days.
10.5 Fees
If you commence arbitration, Trutopia LLC dba Highsale will reimburse your filing fee for claims of $10,000 or less. Any arbitration hearing will take place at a location agreed upon in Scottsdale, Arizona.
10.6 No Class Actions
YOU AND TRUTOPIA LLC DBA HIGHSALE AGREE THAT EACH MUST BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10.7 Modifications
If Trutopia LLC dba Highsale makes any future change to this arbitration provision, you may reject the change by sending written notice within 30 days.
10.8 Enforceability
If any provision of this Section 10 is unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.
11. Deactivation and Termination
The Agreement is effective until your member account is deactivated by either you or Trutopia LLC dba Highsale and you discontinue all use of our Services. If you wish to deactivate your account, contact us at [email protected].
12. Miscellaneous
12.1 Governing Law
The Agreement is governed by the laws of the State of Arizona, excluding conflicts of law provisions.
12.2 Entire Agreement
The terms of the Agreement constitute the entire and exclusive agreement between Trutopia LLC dba Highsale and you in connection with your use of our Services.
12.3 Changes to the Agreement
We may modify the Agreement at any time. Material modifications will take effect when you accept the modified terms; immaterial modifications will take effect when published.
12.4 Waiver Only in Writing
No waiver by Trutopia LLC dba Highsale of any provisions will be effective unless made in writing and signed by a duly authorized officer.
12.5 Assignment
Trutopia LLC dba Highsale may assign the Agreement at any time without notice. You may not assign your rights without our consent.
12.6 Severability
If any provision is unlawful, void, or unenforceable, it will be given effect to the greatest extent possible and the remaining provisions will remain in full force.
12.7 Interpretation
The titles and annotations in these terms are inserted only as a matter of convenience and have no legal or contractual effect.
